Welcome to WebStar! These Terms of Service ("Terms") govern your access to and use of the WebStar platform, including our mobile applications (iOS and Android), website (beawebstar.com and related domains), services, and features (collectively, the "Platform").

Please read these Terms carefully. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Overview and Acceptance of Terms

WebStar operates three distinct services:

• Audition Experience – A free service for users to upload, showcase, discover, and rate talent videos.
• Agent Experience – A paid subscription service for professional talent agents and scouts.
• Artist Experience – A paid subscription service for independent artists to sell and promote their original media.

These Terms apply to all users of the Platform, including casual users, audition participants, agents, and artists.

2. Eligibility

• You must be at least 13 years old to use the Platform.
• Users under 18 must have parental or guardian consent.
• By using the Platform, you represent that you meet these eligibility requirements.
• We reserve the right to terminate accounts of users who are found to be under 13.

3. User Accounts and Profiles

• You may create an account to access certain features.
• You are responsible for maintaining the confidentiality of your account credentials.
• Profiles are primarily for talent showcases, ratings, and Artist storefronts. General social posting is not permitted.
• You may choose anonymity when uploading audition videos. You may later choose to reveal a screen name or real name.

4. User-Generated Content (Audition Videos and Artist Content)

• You retain ownership of the content you upload.
• By uploading content, you grant WebStar a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, display, distribute, and promote your content on the Platform.
• You represent that you own or have all necessary rights to upload and share the content, and that it does not infringe third-party rights.
• Prohibited Content: No sexually explicit material (X-rated), hate speech, harassment, illegal content, or material that violates applicable laws.

5. Ratings, Stages, and Progression

• Community ratings determine progression through Stages 1-5 and Stage Left.
• Ratings are subjective and provided by other users. WebStar does not guarantee any specific rating outcome or progression.
• We reserve the right to moderate, remove, or adjust ratings or stages in cases of suspected manipulation, fraud, or policy violations.

6. Agent Experience

• This is a premium paid service.
• Access is limited to verified professional agents and scouts.
• Subscription fees are non-refundable except as required by law.
• Agents agree not to use the Platform for unauthorized solicitation or to circumvent WebStar's systems.

7. Artist Experience and Storefronts

• Artists pay a monthly subscription fee ($14.99 base + optional $4.99 video ad feature).
• Artists receive a customizable storefront for selling their own original media.
• Artists are solely responsible for setting prices, fulfilling orders, and complying with all sales, tax, and delivery obligations.
• WebStar processes payments via PayPal and disburses proceeds to artists according to the Artist Experience agreement.
• Artists are responsible for ensuring all content sold is original and owned by them.

8. Payments and Subscriptions

• All subscription fees are charged automatically and are non-refundable unless otherwise stated.
• You authorize us (or our payment processors) to charge your chosen payment method.
• We may change pricing with notice.
• Taxes may apply and are your responsibility.

9. Intellectual Property

• WebStar and its logos, designs, and technology are owned by WebStar LLC and protected by copyright, trademark, and other laws.
• You may not copy, modify, or reverse-engineer any part of the Platform.

10. Privacy

• Your use of the Platform is also governed by our Privacy Policy.
• By using WebStar, you consent to the collection and use of information as described in the Privacy Policy.

11. Prohibited Conduct

You agree not to:

• Upload content that violates laws or third-party rights.
• Attempt to manipulate ratings, stages, or search results.
• Harass other users or creators.
• Use the Platform for illegal purposes.
• Circumvent any technical or security measures.
• Scrape or extract data without permission.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, with or without notice. You may cancel your subscriptions at any time, subject to ongoing billing cycles.

13. Disclaimers

The Platform is provided "AS IS" and "AS AVAILABLE." We do not guarantee any level of success, discovery, ratings, or income. We are not responsible for interactions between users, agents, and artists.

14. Limitation of Liability

To the fullest extent permitted by law, WebStar shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amounts you paid to us in the twelve months preceding the claim.

15. Indemnification

You agree to indemnify and hold WebStar, its owners, officers, employees, and agents harmless from any claims, losses, or damages arising from your use of the Platform or violation of these Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Virginia.

17. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes. Your continued use after changes constitutes acceptance of the new Terms.
